These Terms of Service (“Terms”) govern your access to and use of the websites, content, booking systems, communications, and wellness services offered by Abundant Life Energy LLC (“Abundant Life Energy,” “we,” “us,” or “our”). By accessing or using our site or services, you agree to these Terms. If you do not agree, do not use our site or services.

Wellness Notice: Our services support relaxation and general wellness. We do not diagnose, treat, cure, or prevent medical conditions. We are not a healthcare provider. Our services are not a substitute for medical, psychological, or other professional advice, diagnosis, or treatment.

1) Eligibility and Accounts

You must be at least 18 years old to book services. If you are 13–17, a parent or legal guardian must book on your behalf, attend where appropriate, and consent in writing.

You are responsible for the accuracy of information you provide, including intake forms and contact details.

If you create an account, keep your login secure and notify us of any suspected unauthorized use. We may suspend or terminate accounts for violations of these Terms.

2) Booking, Cancellations, and No-Shows

Scheduling: Sessions are available by appointment only and may be offered in person or remotely.

Cancellations/Rescheduling: Please cancel or reschedule at least 24 hours before your appointment time. Late cancellations or no-shows may be charged up to the full session fee.

Late Arrivals: Late arrival may reduce session time to avoid impacting subsequent clients; full fees may still apply.

Changes: We may need to reschedule due to practitioner availability, equipment, or other reasons. If we cancel, you may reschedule without penalty.

3) Payments, Pricing, and Refunds

Payment: Fees are due at booking or at time of service, as indicated. We may use third-party payment processors; their terms apply.

Pricing: Pricing is subject to change at any time. Posted promotions may include restrictions and expiration dates.

Refunds: Except where required by law, all sales are final once services are rendered. Prepaid packages, deposits, or missed appointments are refundable only as stated at purchase or where required by law.

4) Wellness Services and Client Responsibilities

Scope: Services include non-invasive wellness modalities (e.g., microcurrent neurofeedback, sensory entrainment, light and low-intensity magnetic wellness). We do not offer medical care.

No Guarantees: Individual experience varies. We do not guarantee outcomes or specific results.

Screening: You agree to disclose relevant information, including implanted electronic or metal devices, pregnancy, seizure history, or skin conditions. We may decline or modify services based on safety considerations.

Self-Care: Consult your licensed healthcare professional before making health decisions, starting, stopping, or changing medications or treatments, or using wellness devices.

Emergencies: Do not use our services for emergencies. Call 911 or your local emergency number.

5) Tele-Wellness and Remote Sessions

Remote sessions may involve audio/video communication and the use of consumer devices under your control.

You are responsible for a private, safe environment and a reliable internet connection.

You consent to the inherent limitations of remote services.

6) Informational Content and No Professional Advice

Content on our site, emails, videos, or materials is for educational purposes only.

Nothing we provide constitutes medical, psychological, legal, tax, or other professional advice.

7) Communications; SMS and Email

By providing contact information, you consent to receive service-related communications (e.g., confirmations, reminders, updates) by email and/or SMS.

SMS Terms: Message and data rates may apply. Message frequency varies. Text STOP to opt out and HELP for help. Consent to marketing SMS is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

You may unsubscribe from marketing emails via the link in any email.

8) Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms. If these Terms conflict with the Privacy Policy regarding privacy matters, the Privacy Policy controls.

9) Intellectual Property

You may not copy, reproduce, modify, distribute, display, sell, or create derivative works from our content without prior written consent.

User Content: If you submit testimonials, reviews, comments, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content in any media for our business, marketing, and informational purposes, subject to applicable law and our Privacy Policy.

If you use consumer wellness devices at home or during remote sessions, you are responsible for following manufacturer instructions and safety guidelines.

Consumer devices discussed or demonstrated are not medical devices unless stated by the manufacturer, and we do not represent them as such.

14) Disclaimers

To the fullest extent permitted by law:

“As Is” Basis: The site and services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

No Warranties: We do not warrant that the site or services will be uninterrupted, error-free, secure, or meet your requirements.

15) Limitation of Liability

To the fullest extent permitted by law:

Abundant Life Energy, its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill; or replacement costs arising from or related to the site or services.

Our total liability for any claim will not exceed the amount you paid to us for the service giving rise to the claim in the three (3) months preceding the event, or $250, whichever is greater.

Some jurisdictions do not allow certain limitations; some limits may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless Abundant Life Energy and its owners, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

(a) your use of the site or services; (b) your violation of these Terms; (c) your violation of any law or rights of a third party; or (d) your misuse of any content or device.

17) Changes to Services and Terms

We may modify or discontinue any part of the site or services at any time without notice.

We may update these Terms from time to time. The Effective Date shows the latest revision. Continued use after changes means you accept the updated Terms.

18) Suspension and Termination

We may suspend or terminate your access at any time for conduct that we believe violates these Terms, harms other users, or creates risk for us.

Upon termination, your right to use the site and services ceases immediately. Provisions that by their nature should survive will survive (e.g., intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution).

19) Dispute Resolution; Arbitration; Class Waiver

Informal Resolution: Contact us first to try to resolve any dispute.

Binding Arbitration: If we cannot resolve a dispute informally, you and Abundant Life Energy agree to resolve any claim arising out of or relating to these Terms, the site, or services by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Venue and Governing Law: Arbitration will take place in Tarrant County, Texas, or by video/phone when appropriate. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.

Class and Jury Waiver: You and we agree to arbitrate only on an individual basis. Class actions, class arbitrations, private attorney general actions, and consolidation of claims are not permitted. You and we waive the right to a jury trial.

Small Claims: Either party may bring an individual action in small claims court in Tarrant County, Texas, instead of arbitration.

If the class waiver is found unenforceable, this arbitration agreement is void as to that dispute, and the dispute will be resolved in court in Tarrant County, Texas.

20) Severability

If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.

21) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.

22) Entire Agreement

These Terms, together with our Privacy Policy and any written service-specific terms, form the entire agreement between you and Abundant Life Energy regarding the site and services.
